Title: Terms of Reference (TOR) for International Humanitarian Law (IHL) Clinic

1. Background: The International Humanitarian Law (IHL) Clinic aims to facilitate research and analysis on the compatibility of IHL resolutions with Pakistani laws. This initiative seeks to ensure a thorough understanding of how international legal frameworks intersect with domestic legislation in Pakistan, particularly concerning matters of humanitarian concern.
2. Objective: The primary objective of this TOR is to identify and engage with a legal expert or scholar who possesses comprehensive knowledge and expertise in both international humanitarian law and Pakistani legal frameworks. The expert will provide insights and analysis on the compatibility of IHL resolutions with Pakistani laws, offering recommendations and guidance where necessary.
3. Scope of Work: The selected expert will undertake the following tasks:
• Conduct a comprehensive review of relevant IHL resolutions, conventions, and treaties.
• Analyze the provisions and principles outlined in these international legal instruments.
• Examine the existing legal framework in Pakistan, including statutes, regulations, and case law.
• Assess the compatibility of IHL resolutions with Pakistani laws, identifying any areas of alignment or divergence.
• Provide recommendations and legal opinions on ensuring coherence and compliance between international humanitarian law and domestic legislation in Pakistan.
• Offer guidance on potential legal reforms or amendments to enhance alignment with IHL standards, where applicable.
4. Deliverables: The expert will deliver the following outputs:
• A comprehensive report detailing the findings of the analysis, including an assessment of compatibility between IHL resolutions and Pakistani laws.
• Legal opinions and recommendations outlining strategies for enhancing coherence and compliance with international humanitarian law.
• Any additional documentation or resources deemed necessary to support the analysis and recommendations.
5. Confidentiality: All information shared and discussed during the course of this consultancy will be treated with the utmost confidentiality and used solely for the purpose of this project.
This TOR outlines the parameters and expectations for engaging a legal expert to analyze the compatibility of IHL resolutions with Pakistani laws. The selected candidate will play a crucial role in providing valuable insights and recommendations to enhance legal coherence and compliance in matters of humanitarian concern.
